Costco Sues Trump Administration, Seeking 'Full Refund' From Tariffs

Costco is suing the Trump administration over the sweeping tariffs the president imposed on its trading partners.

According to The Hill, Costco, represented by the law firm Crowell & Moring, filed a lawsuit seeking a full refund of tariffs it paid amid Trump's sweeping trade actions.

The retailer is among dozens of companies that are pursuing similar cases against the administration as the Supreme Court prepares to rule on whether Trump legally invoked the International Emergency Economic Powers Act (IEEPA) to impose broad tariffs on U.S. trading partners.

Costco said the suit is necessary to secure reimbursement should the Court strike down Trump's tariff policy. According to the suit, Costco is "not guaranteed a refund for those unlawfully collected tariffs" without its own judgment separate from the Supreme Court's decision.

Other companies seeking refunds include auto manufacturers such as Kawasaki and Toyota Group, Revlon, and even board game maker Smirk & Dagger Games.

Trump first invoked IEEPA in February when he declared a fentanyl emergency to levy tariffs on China, Canada, and Mexico. He later declared a trade deficit emergency and expanded the program into a sweeping set of “reciprocal tariffs” on countries around the world.

The Supreme Court is weighing whether Trump exceeded his authority under IEEPA, a 1970s emergency powers law that grants presidents unilateral authority to “regulate” imports in response to national emergencies. Challengers in that case, including Democratic-led states and small businesses, argue that Trump stretched the statute beyond recognition.

A ruling is expected to determine not only whether Trump’s emergency declarations were lawful, but also whether companies like Costco will be entitled to billions in tariff refunds.
